ICC APPROVES KAUFMAN'S WITHDRAWAL AS DUTERTE DEFENSE COUNSEL

In the ruling titled “Decision on Request to Withdraw as Counsel for Rodrigo Roa Duterte,” the Chamber stated that Kaufman’s withdrawal would not result in procedural prejudice or delays in the proceedings, citing assurances that a replacement counsel is prepared to immediately assume representation of the former president.

The International Criminal Court (ICC) Trial Chamber III has officially granted lawyer Nicholas Kaufman permission to withdraw as lead defense counsel for former president Rodrigo Duterte, according to a five-page public decision released on May 11.
The decision stemmed from a request filed by Kaufman on May 8 pursuant to Regulation 78(1) of the ICC Regulations of the Court. The Chamber noted that Duterte himself expressed the desire to release Kaufman from his legal representation and appoint a new counsel in his place.
According to the document, Kaufman had already coordinated with the incoming replacement lawyer, who confirmed readiness to take over the case and attend the next status conference scheduled for May 27, 2026. The Chamber further emphasized that the terms of engagement between Duterte and the new legal representative had already been finalized.
“The Chamber is of the view that no prejudice arises or inconvenience is caused by accepting Mr. Kaufman’s withdrawal,” the ruling stated, highlighting that the transition in counsel would not disrupt the current stage of proceedings.
The ICC also reminded Kaufman of his continuing obligations under the Code of Professional Conduct for counsel, including confidentiality responsibilities under the Rome Statute and Rules of Procedure and Evidence.
Additionally, the Chamber addressed the redaction of the incoming lawyer’s identity from the public filing. It ordered that unless sufficient justification for confidentiality is provided, the Registry may reclassify portions of the request as public.
The development marks a significant transition in Duterte’s legal team as proceedings before the international tribunal continue under the ICC’s investigation into alleged crimes against humanity linked to the Philippine anti-drug campaign during his administration.
Political observers and legal analysts are now closely watching who will officially replace Kaufman and how the change in defense strategy could affect Duterte’s ongoing case before the Hague-based court.
